placing a Canadian auto Lien
I have a car that my ex business partner who owed me a considerable
amount of money left with me going on 4 (four) years as of Aug.08 I have been driving the car (with Canadian tags) this whole time I have spent over 6k in repairs, and have had several conversations with my ex partner he always says that he is going to payoff the leasing company and send me the title to NO Avail. He is now in drug rehab, and I have not had any communication with him in over 9 months. Can I palce a lien on the car and request title? or does anyone know what the procedure is for trying to get the title in my name? |

Can I place a lien on the car and request title? or does anyone know what the procedure is for trying to get the title in my name? This is a legal question, not a travel question, but if you're willing to accept some half-assed armchair quarterbacking, that's just a wild-guess and not to be construed as legal advice.... IMO, w/o a written consent to effect a transfer, i.e. power of attorney or bill of sale, you'd need to sue him and use your judgment to attach a lien and auction the vehicle it to satisfy it. Does he owe you the $6k in repairs? No. He didn't ask you to do that, which leaves you with the "business debts." |

does anyone know what the procedure is for
trying to get the title in my name? Speaking to a lawyer is probably best in this situation, but if you're looking for free advice you could try calling the local Auto Title office. I believe it's listed under Clerk of Courts. Or you could call the local Bureau of Motor Vehicles and they could give you the number. James |
