Hi,

a booking is never valid untill they get your deposit. words on the
phone???????????? you can't proof this. sorry.

That's not the point. Legally, you are right. But: they confirmed his
booking verbally - in this case, the customer has a right to expect
them to hold the car for him. Especially in a service-oriented
society like Australia. If this had happened in Asia I wouldn't have
been surprised.

Actually, he isn't. It is possible to enter into a contract verbally,
although it is extremely difficult to prove the terms of that
contract.

Nevertheless, if they agreed over the phone to hold it until the
Monday, then that is a contract, even though it is not in writing
(under Australian law anyway).

Chances of enforcement are nil though.....

OP said they he was told they would hold the reservation until Monday .

No, the OP didn't say that! Please read what he wrote, not what you
think he wrote.

It is important what the OP *actually* 'said' (AFAIK, all
communication was by email, i.e. not (partly) by phone) and what
Camperworld *actually* 'said'.

So, from the information which we *do* have, it is quite possible that
Camperworld did not consider it a booking, reservation, whatever,
until they received the deposit.

He said he faxed them Monday morning. Just wondering..... what time would
that have been in Perth???
Maybe Camperworld did hold the booking as promised. .... but on Australian
time.
Still waiting to hearfrom the OP as to why he didn't confirm by email.

Yes you are correct.....
I am on Camperworlds side here until convinced otherwise.
We are in the travel business and people quite often make contact and ask us
to hold rooms for them. We always set a time limit,- maximum of 24hours- for
cc details to be sent ( email or phone). After the time limit the room is re
marketed

A warning:

BE AWARE THIS COMPANY IS NOT RELIABLE.

In part due to the praise about camperworld (perth) in this newsgroup
I decided to book a pop-top bushcamper with them. Doug, who was very
friendly in his e-mail (at first) convinced me that this was the best
choice for us.

I booked on friday. But since I do not have a faxmachine at home I
asked whether I could send it in another way (e.g. PGPmail) or if I
could fax my creditcard details on monday. I got a confirmation with
the reply that it was OK to fax it monday.

However, after I faxed my creditcard number first thing mondaymorning,
I got a reply that some travel agency booked all the remaining
pop-tops for my rental period on saturday, so there was no
availability.

I booked on friday, which in my book is before saturday, but this does
not seem to count for them, the travel agency probably brings more
bucks, so they decided to screw me over.

So fellow travellers, be warned. Yes they are cheap, but THEY ARE NOT
RELIABLE. Consider what is more important in the long run.

I'm now going for SP4WD, and hope that they will keep their word.

Hi Eric,

we have booked five times a camper from Camperworld and pay a bond to secure
our bookings. We have never had a problem to get the camper.
