Default Flatulence Allegedly Sparks Jail Fight

Our dear friend Barry Braimah said this was a very real problem when he
was in Clairvaux


Brian Bruggeman caused a stink at the Lincoln County Jail earlier this
month and will now have to answer for it in court. Another inmate,
Jesse Dorris, alleges that Bruggeman's flatulence, passed in close
proximity to Dorris, sparked a Dec. 14 fight between the two at the
jail.
Now Bruggeman, 38, faces a Jan. 11 preliminary hearing on the state's
complaint of assault by a confined person. It's a felony punishable by
up to five years in prison.

Bruggeman is accused of injuring Dorris, his cellmate, when he pushed
him into cell bars. Dorris, 26, was not charged.

The two began scuffling, County Attorney Jeff Meyer said Tuesday,
because Dorris was fed up with Bruggeman's flatulence.

Jail fights are common, Meyer said, but the cause of this one was
rather uncommon.

"It's usually about someone hogging the newspaper or someone not happy
about what's on TV," he said.

Bruggeman, of Hershey, is serving a 90-day sentence for violating a
protection order.

"He compounded his problems," Meyer said.

Dorris, of North Platte, is awaiting a January trial on a charge of
aiding and abetting robbery.

Brad Dawson, Bruggeman's attorney, did not immediately return a phone
message left at his office.

Sheriff Jerome Kramer said the incident was a result of overcrowding.
The jail was built in 1933 and has a capacity of 23 inmates, according
to 2006 standards, Kramer said. As many as 65 inmates have been lodged
at the jail in recent days, he said.

"You just can't get a reprieve from one another," Kramer said. "When
you've got a guy causing problems passing gas, there's no way to get
away from the smell."

Wrong, the devil is in the details and there have been
convictions and fines in France for web forgery. Web
forgery is covered by current French law on forgery
in general. Have YOU ever done it? I see no posting
you have made which constitutes forgery, and certainly
not a couple hundred of them. Being the kind of person
you are, you would do it if you thought you could.

By the way, why do you use a phony address when you
have a wanadoo account?

Every time you see a message supposedly from Earl Evleth with the header
that is a message forged by Runge. He's so very
proud of these efforts.

You are in error on this point. It is the contents and purpose
of the forged posts which creates the problem for the forger.
Judging by the contents of some of those postings I have
read, that can carry a heavy fine for the forger. I suppose
that forger is not you, if so you have problems.

L'usurpation d'identité peut coûter cher

Une salariée a dû verser plus de 11 000 euros au titre de préjudices
corporels et moreaux pour s'être fait passer pour une collègue sur
des sites de rencontres.

Même si aucun texte ne punit expressément l'usurpation d'identité,
il peut en coûter cher à celui qui y a recours même pour faire une
plaisanterie de mauvais goût. Ainsi, une salariée a été surprise en
flagrant délit, alors qu'elle utilisait l'ordinateur de son directeur
pour fréquenter des sites de rencontres en se faisant passer pour une
autre employée et en divulguant les coordonnées téléphoniques de sa
collègue de bureau.

La victime - dont la fragilité psychologique était établie - a très
vite été assaillie d'appels téléphoniques, dont la teneur et la
fréquence considérable lui ont causé un choc tel qu'elle a obtenu un
arrêt de travail de dix jours. Le tribunal correctionnel a considéré
qu'il s'agissait là de « violences volontaires ayant entraîné une
incapacité totale de travail supérieure à huit jours » commises
avec « préméditation », l'utilisation du poste du directeur ayant
« induit nécessairement que les faits n'ont pas été commis de
façon spontanée » (TGI de Carcassonne, 16/06/2006).

Au total, la salariée a été condamnée à verser plus de 11 000
euros au titre des préjudices corporels et moraux. Une proposition de
loi visant à punir d'un an de prison et de 15 000 euros d'amende
l'usurpation d'identité numérique sur les réseaux informatiques a
été déposée en 2005 (voir Micro Hebdo n° 427).
