The ballot proposal takes issue with a provision in the new regulations penalizing people who don't buy health insurance. The measure proposes an amendment to the Florida constitution prohibiting some parts of President Obama’s health care legislation from taking effect in the state. Most noticeably the part which nullifies the so-called Federal mandate that individuals must buy into a health insurance pool. In a news release, the measure’s sponsor, Representative Scott Plakon (R-Longwood) said, “The government has never required citizens to purchase a product from a private for-profit company as a condition of lawful residence in the United States.” Specifically, the language of the bill, should it become law it will, “…prohibit laws or rules from compelling any person, employer, or health care provider to participate in any health care system, …” In the statement from House Majority Leader, Adam Hasner he says, “The Federal Health Care Reform legislation recently signed into law by President Obama forces uninsured individuals to purchase health insurance or face penalties imposed by the IRS.” Legal experts on both sides of the issue agree the requirement that Americans purchase health insurance will test the reach of the federal government....." With new laws threatening individuals who refuse to buy health insurance with penalties from the IRS, supporters of the proposed amendment said this would allow Floridians freedom and choice with their health-care decisions. Attorney General Bill McCollum has filed a lawsuit against the new federal laws. The amendment will be added to the state constitution if it gets 60 percent of voters' support come November.
