HSBC say they will pay out what (and why)?


out of goodwill, they says it's act of god but they will meet annual
policy holders losses, I'm afraid I didn't read it all as I do not
have a claim.

Oh you mean to people with their travel insurance. I thought that perhaps
you were talking about their credit cards (under S75)

There are two different situations. One is where a passenger has booked
a flight with the airline. In the case of force majeure such as a
natural disaster like the volcano, the passenger is entitled to a refund
or free rebooking, but not much else. The rules are covered by European
legislation:

If the flight is taking place as part of a package tour, then the
passenger has a contract with the tour operator, not the airline. It
then all depends what is in the small print in the contract with the
tour operator.
However, the tour operator can simply cancel the contract, citing force
majeure.
