NCL being sued by radio station in TN
I tried to google and find something about this, but couldn't. As we were
driving through TN yesterday, we caught a radio station that had planned a group cruise on NCL, and the cruiseline cancelled because they felt that *the listeners of the station did not fit the family image of NCL*. Apparantly, NCL had heard of some *wild* behavior on previous group cruises from this radio station, which the station claims unjust. From what I could tell, the station booked group space in April or May, for an October cruise. Many people deposited and planned their vacation time. On July 21st, the radio station was informed that their group could NOT cruise on NCL, and that all deposits would be refunded. The station has now sued for 1.3 million dollars in damages, for breach of contract. I do not recall the name or call numbers of the station (it was either Nashville or Chattanooga), but the show that was hosting the cruise was called *Monsters in the morning* I just thought this was kind of interesting. Has anyone else heard about this? Pam |

Pam: Just scroll down. The header reads $1.3 million lawsuit against NCL. There are 32 postings. SInce none of us know what transpired during their last cruise (cabins could have been found trashed (following their debarkation), or how the group booking was made in the first place (perhaps the agent knew they weren't being welcomed back and tried to push the booking through anyway), who are we to say. Of course, the $64,000 question is.. "What are your damages?" Other than some nonrefundable air tickets, hotel which should have been covered by travel insurance, once the deposits are returned.. there are no damages, except for noses out of joint. Babette |

What about the ad-time the station gave NCL promoting the cruise and NCL? Lee: In this case, NCL is not the station's client. The radio station is using a cruise.. as a promotional vehicle for themselves. It's all about ratings.....and is frequently done in many radio markets.. especially during radio sweep periods (summertime is one of them). If any party were to be damaged, it could only be the particular agency who did the booking. However, it would depend on what arrangements they had made with the radio station. However, these damages are not permanent.. if they paid for an airtime package including what are called live promo drop-ins (jock talk). The agency could get "make-good's" and run normal ad copy. If the agency were running airtime based upon a barter arrangement ( say the station gave away a free cruise for two last spring ) and the agency received free airtime in exchange for that cruise, they can still get "make good's" and run normal ad copy. Babette I caught that thread later, Babette, apologized, and corrected myself. Although I thought, by listening to the DJs on the station, that they may have been a little over the top, I do believe that they have sustained damages worthy of some sort of lawsuit. Time was spent on organizing the cruise, and air time was used to promote it. I don't know for sure, but I would guess that print advertising might have also been used. The people who actually booked the cruise, have already, supposedly been refunded. If they took time off of work, booked a hotel or air (which I doubt, since it was a local station), then I guess they're just SOL on that if they didn't purchase insurance, or work at a place where vacation time doesn't come easily...
