Mine for now will always originate with comcast.net So will posts forged to look like they come from you. The facts above mentionned were exactly similar in the case Cass. crim. 02.04.98, Bull. p. 350 with fines of 30 000 F & 7 000 F for both defendants. One one them, the president of the Collectif d'Information et de Recherche sur le Cannabis, was the guy who previously send by mail a cigarette of cannabis to all the french members of parliament. I don't know for first level courts (tribunal), but apparently the simple/only wearing of a T-shirt with cannabis leaves as not yet been jugded by a second (appeal) or third (cassation) level of courts since 1988 or, for the published decisions, since 1960 (so after the 1970 law), according to the Legifrance website. But penal appeals being suspensive of the condemnation, it's doubtful that somebody condemned to the maximum penalty would not have made an appeal. In the six decisions published since 1960 the judges gave fines and in one case a "sursis". Nevertheless, it's difficult to make the difference, in the case of T-shirt wearing, between "an incitation to breach the legal interdiction of use" and "an appeal to a debate of idea"... and despite the apparent absence of precise superior courts decision (but I don't know for the lower tribunals), a policeman will probably not consider such a juridical dilemna...
