Presumably, if the driver's not on the rental agreement,
then the car is being driven without the owner's permission.
The renter may not have authority to allow others to drive
under the agreement. Depending how various state laws are
written that can be considered theft of the vehicle.

Then that would be a pretty lax definition of theft (seeing
that the person who has the rental agreement could still
be said to be 'in charge' of the car).

I'm glad that I don't live in one of those states, you'd find
yourself at risk of being banged up if you picked up some
litter off the floor to put in the bin.
