Default McCoy would have prosecuted!

I watched a Closer rerun yesterday. A 12 year old boy is found murdered.
It turns out he stood watch for 3 men who gang raped a woman for days.
The 3 rapists left to get beer and would have continued their assault
when they returned. The woman shot the youngster in order to escape. He
died.

Brenda's boss, Pope, congratulates the team on catching the murderer.
Brenda tells him they caught the person who shot the boy, not the
murderer. Pope asks the difference, and when Brenda explains the
circumstances, he nods and says "Ok, justifiable homicide".

At that moment, I immediately thought Jack McCoy would have never let
her off. He would have prosecuted despite the protest of whichever
beautiful female assistant he was at the moment employing,
