Default 409MHZ FRS wlakie talkie in NZ and Melbourne

Will be going to Auckland and Melbourne next week and want to bring my
Motorola 5428 walkie-talkies for convenience.

Are they legal in both cities. Do I need to declare them at customs??

Thanks

Illegal. Shoiuld be decalared as duty would be payable, and they may be
confiscated.
Those frequencies maybe in use by other services which you will interfere
with, if you use those in Australia.
40 CH UHF band in Australia is 476.425 to 477.400MHZ
see. http://en.wikipedia.org/wiki/UHF_CB
Just buy a pair of hand helds at Dick Smiths they are very cheap
NZ maybe different again.

Never take units from one country to another as the allocated frequencies
are nearly always different.
