Default Cosmos Tours and reschedule insurance?

Back in March 2005, Cosmos Tours were offering free reschedule travel
insurance.

I asked my travel agent before I signed up with the free travel
insurance would be added.

She said she'll add it to my file if its' being offered.

It comes to time for deposit, she happens to wait for the very last
day, or else I lose my booking. So I handed over money for the
deposit.

Then on the last day before I would lose my deposit, she says that I
have to pay the full amount, or lose my deposit.

Now with about a month to go, I need to reschedule and she says I
can't change becuse I didn't get the insurance that I was querying
about.

I can't get into contact with Cosmos tours - they say go to the travel
agent.
The agent has taken all my money, so they don't care.

They are claiming that the free offer was never offered.

1) Does anybody remember seeing a free reschedule insurance through
cosmos tours back in March? They wre charging $75 for each.

2) Apart from getting ripped off, is there anything else I can do?

If there was any misrepresentation involved you could contact Fair Trading
and/or the Association to which the Agent belongs. Apparently you don't
have any documentation to prove your claim, nor have you stated how you got
to know about it the offer - was it in a brochure or some form of
advertising (in-store, TV or whatever?) The onus is on you to state how
this offer was conveyed to you. I believe that Cosmos is a
well-established, reputable tour company and it would seem your travel
agency is too ready to pass the buck if you are correct in your claim.
